# TERMS OF USE **Maleka Property Intelligence** **Effective Date:** 2 June 2026 ## 1. Acceptance of Terms By accessing or using Maleka Property Intelligence ("Maleka", "we", "our", or "us"), you agree to be bound by these Terms of Use. If you do not agree, you must not use the Services. ## 2. Ownership All software, AI models, algorithms, databases, designs, trademarks, branding, content, and intellectual property associated with the Services are owned exclusively by Maleka Property Intelligence and protected by applicable intellectual property laws. No rights are granted except the limited right to use the Services as intended. ## 3. Acceptable Use You agree not to: * Copy, resell, sublicense, or distribute the Services. * Reverse engineer, decompile, or attempt to extract source code. * Access the Services unlawfully or bypass security measures. * Use the Services for unlawful, fraudulent, or harmful activities. * Interfere with the operation, security, or integrity of the Services. ## 4. User Content You retain ownership of content you submit. However, you grant Maleka a worldwide, non-exclusive license to process, store, analyze, and use such content solely for providing, improving, securing, and operating the Services. ## 5. Artificial Intelligence Services AI-generated outputs are provided "as is" and may contain inaccuracies. Users are solely responsible for reviewing and verifying any output before relying on it. Maleka does not provide legal, financial, tax, investment, or professional advice. ## 6. Suspension and Termination Maleka may suspend, restrict, or terminate access to the Services at any time if it reasonably believes a user has violated these Terms, poses a security risk, or misuses the Services. ## 7. Disclaimer of Warranties The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Maleka disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. ## 8. Limitation of Liability To the maximum extent permitted by law, Maleka Property Intelligence shall not be liable for any indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from or related to the use of the Services. In all cases, Maleka's total liability shall not exceed the amount paid by the user to Maleka during the twelve (12) months preceding the claim. ## 9. Indemnification You agree to defend, indemnify, and hold harmless Maleka Property Intelligence, its directors, employees, affiliates, and partners from any claims, damages, liabilities, losses, costs, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights. ## 10. Modifications Maleka may update these Terms at any time. Continued use of the Services after updates constitutes acceptance of the revised Terms. ## 11. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa. ## 12.
